These general terms and conditions regulate the relationship between „КОФЕ 1980“ Ltd and the persons using the website and the online store at coffee-machines.eu

Definitions

  • “WE”, “ КОФЕ 1980”, “THE COMPANY” means „КОФЕ 1980“ Ltd with headquarters and principal place of business: Bulgaria, city of Sofia, Levski-G, bl.32, en.3, ap.55, registered in the commercial register of the Registry Agency with UIC: 206515938, e-mail: info@coffee-machines.eu.
  • “PDPA” – means Personal Data Protection Act;
  • “POSA” – means Postal Services Act;
  • “SITE” – means Web Site located at coffee-machines.eu;
  • “ONLINE STORE” – means the virtual store located at coffee-machines.eu, which provides the opportunity to purchase goods over the Internet;
  • “USER” – means a person who uses the website’s features;
  • “BUYER” – means a person who performs purchase of goods through the online store;
  • “PERSONAL DATA” – means personal data in the meaning of the PDPA;
  • “CASH ON DELIVERY” – means cash on delivery pursuant to the POSA;
  • “GENERAL TERMS AND CONDITIONS” – means these general terms and conditions.

By clicking on any link, button or application available on the site, with the exception of the link pointing to these terms and conditions, you expressly and unconditionally agrees to these general terms and conditions for using the website and the online store.

Registration

The website can be viewed freely without registration. Registration is required only when using certain features of the website and is absolutely voluntary and free.

Mandatory fields are marked with an asterisk.

General provisions

Only those goods which the system allows to be added to the shopping cart may be purchased through the online store. All information on goods presented in the website, including, but not limited to technical characteristics, warranty, instructions for use, etc. is provided by the manufacturer. „КОФЕ 1980“ Ltd is not responsible in case of false, incorrect or inaccurately presented information, accurate information presented in a misleading way, discrepancies between the presented and the actual situation, misprints. All pictures shown are for illustration purpose only. Actual product may vary due to product enhancement.

Prices

All prices shown on the website/online store are in LEVA and are valid only at the time of their publication. „КОФЕ 1980“ Ltd reserves the right to change them without notice at any time. The prices of online purchases, confirmed by „КОФЕ 1980“ Ltd are final and shall not be changed. The prices on the website/online store are final and include all taxes and fees, except the price for processing and delivery, indicated separately, when such is due.

Orders

Only users who have accepted the general terms and conditions can place orders.

Payment

The price due for goods ordered through the online store can be paid by one of the following methods:

  1. Cash on delivery
  2. Bank card payment
  3. Bank transfer

Please, consider that in certain cases some of the payment methods can be unavailable for certain orders. All payments are made in LEVA only. By accepting these terms and conditions the buyer agrees expressly and unconditionally, in all cases, except for the “cash on delivery” payment, including but not limited to using the “Pick up from Warehouse” option, to pay to „КОФЕ 1980“ Ltd, in advance and in full amount, the purchase price of any item ordered through the online store. If paying via “cash on delivery” the buyer hands over to the courier the total amount (including the purchase price and price for processing and delivery) specified in the invoice/receipt and authorize the courier to hand it over to „КОФЕ 1980“ Ltd on his/her own behalf and account; the payment is specified in the document, verifying the delivery of the item, serving as a proof of receipt.

Contract

The distance sale contract between „КОФЕ 1980“ Ltd and the buyer shall be deemed concluded at the time of confirmation of the specific order by „КОФЕ 1980“ Ltd.

Delivery

Goods are received only by signing of a document certifying the delivery and acceptance of goods. „КОФЕ 1980“ Ltd reserves its right unilaterally, without informing the buyer, to extend all delivery times by up to 14 days.

Pick up from Warehouse

“Pick up from Warehouse” provides the possibility of taking the goods ordered through the online store from Warehouse. In order to benefit from the “Pick up from Warehouse” option you have to: Order the goods through the online store. Fill in all fields in the order form and indicate a recipient of the goods. Pay the goods price, and then receive an electronic confirmation by „КОФЕ 1980“ Ltd of the order. The goods should be picked up no later than 30 (thirty) calendar days from the date of the electronic confirmation of the order; the pick-up is to be done only in the working time indicated in the electronic confirmation; only by the person indicated as a recipient, after presenting an identification document, order number and signing delivery and acceptance slip.

Review of the product

Upon receipt of the product the buyer is obliged to review it and if he/she finds evident shortcomings, missing accompanying accessories and/or missing documents required by the Bulgarian legislation, he/she shall immediately inform the person making the delivery. Failure in doing so, the product is deemed approved and the buyer loses the right to claim that it was delivered with evident shortcomings, missing accompanying accessories and/or missing documents required by the Bulgarian legislation, at a later date.

Protection of personal data

By accepting these terms and conditions, the user gives his/her express indefinite and unconditional consent, until its explicit written cancellation, his/her personal data to be collected, stored, processed and used by „КОФЕ 1980“ Ltd and/or by third parties authorized by the company, including but not limited to: courier services companies, banks and others, for the purpose of execution of the distance sale contract and delivery of ordered goods, in relation with marketing and promotional purposes and analyzes of „КОФЕ 1980“ Ltd, participation in games, promotions and raffles organized by the company and for any other purposes not prohibited by law. The user may at any time receive information whether his/her personal data is being processed and used by „КОФЕ 1980“ Ltd, and the purposes of processing and use.

The user is obliged to protect the confidentiality of the user name and password provided to him/her by „КОФЕ 1980“ Ltd. Every order made through the online store shall be considered regular by „КОФЕ 1980“ Ltd, if when placing such an order a user name and password accepted by the system as valid were used, regardless of whether they were used by a person other than the holder or by unauthorized person.

Other provisions

„КОФЕ 1980“ Ltd is committed to providing only the services presented on the site, in the way they are presented. „КОФЕ 1980“ Ltd reserves the right to change it without notice at any time. It is the user’s responsibility to check the website’s terms of use, as well as the information on prices, availability, etc., so that he/she is promptly informed of any changes which may have occurred thereupon. In all cases, the change shall be effective in future and shall not affect orders confirmed by „КОФЕ 1980“ Ltd prior to its occurrence.

Access to the resources of the website and the online store will be blocked for incorrect users. Accounts of users who violate the terms of use of the website and the online store, as well as accounts of users who use them for other purposes, will be deleted.

The provisions of the existing Bulgarian legislation shall apply for all issues not settled in these general terms and conditions. Any disputes concerning the interpretation and implementation of these general terms and conditions, and the interpretation and implementation of distance sale contracts for order of goods through the online store will be resolved by an agreement, and in the event of failure to reach an agreement, the dispute will be referred to to the competent court.
